The Bharatiya Sakshya Adhiniyam, 2023 (BSA), which replaced the Indian Evidence Act, 1872, effective July 1, 2024, modernizes evidentiary rules to focus on digital records and electronic evidence. It categorizes electronic/digital records as primary evidence, streamlines procedures, and includes 170 sections, aiming for a fair trial.
 
Key Changes and Features in the New Act (BSA, 2023):
  • Electronic Records as Primary Evidence: The BSA shifts digital records (emails, server logs, smartphone messages, documents on laptops) from secondary to primary evidence.
  • Definition of "Document":
    Broadened to explicitly include electronic and digital records, such as information stored in semiconductor memory or communication devices.
Admissibility of Digital Evidence: The Act provides a legal framework for digital signatures and electronic records, allowing oral evidence to be presented through electronic means (e.g., video conferencing).Structure and Simplification: The Act is organized into 4 parts, 12 chapters, and 170 sections. It removes outdated terminology.Forensic Evidence: The Act mandates the involvement of forensic experts for collecting evidence in serious offenses.Scope: It applies to all judicial proceedings, including court-martial, but not to affidavits.
